Grannyflat4u contracts to various suppliers for the builds.  

Granny flats 4u contracts the floor plan and product build out to a supplier. The supplier does not own the copyright on the floor plan or the product or the finished pictures taken on the product. The product title is signed over to the respective client. Image IP and Ownership remains with Granny flats4u.

Ownership of the Product (Built Container)

  1. Work-for-Hire: If the builder was hired as an independent contractor and there was no agreement transferring the rights to the builder, you would typically own the copyright to the floor plan. The ownership of the physical product would depend on the terms of the agreement between you and the builder. 

  2. Sale of Physical Product: If the builder constructed the container according to your specifications and you paid for the work, you typically own the physical container. However, any plans or blueprints you provided would still be protected by your copyright unless you transferred those rights.

  3. Contracts and Agreements: The specifics of any contract or agreement between you and the builder are crucial. If there was an agreement that included terms about intellectual property rights, ownership of the final product, or other related aspects, those terms would take precedence.

 

 The rights to the images of the finished product depend on who took the pictures and the agreements in place regarding those images. Here’s a breakdown:

Who Took the Picture?

  1. You (or Your Employee): If you or someone working for you took the picture, you/your company hold the copyright to that image. You have the exclusive rights to reproduce, distribute, and display the image unless you transfer those rights to someone else.

  2. The Supplier: If the supplier took the picture, the supplier holds the copyright to that image unless there is an agreement that transfers the rights to you or the client.  A contract/ Invoice for the product where the Title of the product is transferred was in place.

  3. The Client: If the client took the picture, they hold the copyright to that image.

Agreements and Contracts

  1. No Specific Agreement: If there is no specific agreement regarding the ownership of the photos, the copyright belongs to whoever took the pictures.

  2. Agreement or License: If there is an agreement (e.g., in a contract) that specifies the ownership of the images or grants usage rights, that agreement will determine who retains the rights. For instance, you might have an agreement with the supplier or client that grants you the rights to use the images for promotional purposes.
